Tassazione agevolata del 10% 2011 - problematiche evidenti, lettera al Ministro Sacconi

Egregio Ministro,
Egregio Direttore,
abbiamo esaminato con cura il contenuto della Circolare n.3/E del 14 febbraio 2011 avente per oggetto l’imposta sostitutiva del 10% sulle componenti accessorie della retribuzione corrisposte in relazione ad incrementi di produttività.
Dal nostro esame, limitandoci a segnalare gli aspetti essenziali, emergono problematiche e contraddizioni che vogliamo sottoporre alla Vostra attenzione al fine di un riesame del provvedimento .
In particolare tale riesame deve riguardare a nostro avviso le modalità previste per rendere operativa la tassazione del 10% di tutte quelle somme, come lo straordinario, i turni, il lavoro notturno, il lavoro domenicale ordinario, le clausole flessibili e le clausole elastiche riferite ai tempi parziali, ecc .. E’ del tutto evidente che il recepimento dei CCNL, richiesto a tale scopo, con accordi a livello aziendale o territoriale - anche con accordi non scritti come è sottolineato - per l’enorme disomogeneità delle situazioni in essere nel nostro Paese, sia dal punto di vista sociale che contrattuale, rischia da una parte di determinare evidenti disparità di trattamento fiscale tra lavoratori e lavoratori, imprese e imprese - il che propone seri interrogativi circa i diritti inalienabili in tema di fiscalità per tutti i cittadini -, dall’altra di fatto, di affermare procedure che si riducono ad atti puramente formali circa la possibilità di controllo sulla corrispondenza delle finalità del provvedimento con le misure concrete messe in atto dalle imprese, e che nulla hanno a che fare con un ruolo puntuale della contrattazione collective.

For these reasons, the CGIL calls for change circular so as to restore the operation of the measure, as it has done for the year 2010, in all situations where you will apply the National Collective Bargaining Agreement without any further step to negotiating lower levels.
